What EB-5 Eligible New Construction Means
July 24, 2026 · 2 min read
A plain-language overview of how some new-construction projects are structured to participate in the EB-5 program.
“This article is general information only and is not legal, immigration, tax, or financial advice. EB-5 eligibility and requirements are handled by the program's regional center and your own qualified advisors.”
— Important
The EB-5 Immigrant Investor Program allows qualifying foreign investors to pursue U.S. permanent residency through a qualifying investment that creates a required number of jobs. Some new-construction developments are structured to participate through a USCIS-approved regional center.
Where new construction fits
In these projects, the development itself is structured as the qualifying investment vehicle. The builder or its managing company administers the program, the job-creation requirements, and the investor documentation. The real estate and the immigration program are connected by design.
What this is not
Buying a home in a community is not the same as making an EB-5 investment. EB-5 involves specific investment amounts, at-risk capital, job-creation rules, and a multi-stage immigration process. Only the program's professionals can determine eligibility and structure.
Our role is limited: we identify projects that carry EB-5 certification and connect you directly with the managing company that runs the program.
